Lemma (“Lemma”, “we”, “us”) operates heylemma.com and app.heylemma.com, a platform for running AI-led research interviews. These Terms of Service (the “Terms”) govern your access to and use of the platform (the “Service”).
Lemma is operated by Speiros, a French société par actions simplifiée registered with the Marseille Trade and Companies Register under number 994 829 851, with its registered office at 67 Rue Saint-Jacques, 13006 Marseille, France.
By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization, and “you” refers to it. If you do not agree to these Terms, do not use the Service.
Lemma lets customers (“Sponsors”) design research studies and invite people (“Participants”) to be interviewed by an AI interviewer, in writing or by voice. The Service produces and stores interview material for the Sponsor, including transcripts, audio recordings of voice interviews, and AI-generated summaries and analyses.
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old to use the Service. Notify us promptly if you suspect unauthorized access to your account.
You retain all rights to the content you submit to the Service — study definitions, discussion guides, contact lists, interview responses, and any files you upload (“Customer Content”). You grant us the limited rights needed to host, process, transmit, and display Customer Content in order to provide the Service, including processing it with the third-party AI providers described in our Privacy Policy.
Where Customer Content contains personal data, we process it on your behalf as a processor, as described in our Privacy Policy, and we will enter into a data processing agreement where applicable law requires one.
If you are a Sponsor, you are responsible for your studies: you must have a lawful basis to contact the Participants you invite, you must not ask Participants to disclose data you are not entitled to collect, and you are responsible for how you use interview material outside the Service.
Participation in an interview is voluntary, and Participants may stop an interview at any time. Interviews are conducted by an AI interviewer on behalf of the Sponsor who created the study. Responses, transcripts, and (for voice interviews) audio recordings are made available to that Sponsor.
Parts of the Service are generated by artificial intelligence, including interview questions, transcripts, summaries, and analyses. AI output can be incomplete or inaccurate. You are responsible for reviewing AI output before relying on it or sharing it, and the Service is not a substitute for professional advice of any kind.
You agree not to:
Some features require a paid plan or credits. Prices are shown before you pay, and payments are processed by our payment provider (Stripe). Fees are exclusive of VAT and any other applicable taxes; you are responsible for those taxes where they apply. Except where the law requires otherwise, fees and consumed credits are non-refundable. We may change our prices going forward with reasonable advance notice; changes do not affect amounts you have already paid.
The Service, including its software, design, and branding, belongs to Lemma or its licensors. These Terms do not grant you any rights to it beyond what is needed to use the Service. If you send us feedback or suggestions, we may use them without obligation to you.
The Service depends on third-party providers (for example for hosting, data storage, AI models, voice infrastructure, email delivery, and payments). We choose these providers carefully, but we are not responsible for their services beyond what mandatory law provides. The categories of providers that process personal data are described in our Privacy Policy.
We work to keep the Service available and reliable, but it is provided “as is” and “as available”. To the extent permitted by applicable law, we disclaim implied warranties, including fitness for a particular purpose. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.
To the extent permitted by applicable law: (a) neither party is liable for indirect or consequential damages, including loss of profits, revenue, or data; and (b) our total liability arising out of or related to the Service is limited to the amounts you paid us for the Service in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.
If a third party brings a claim against Lemma arising from your Customer Content, or from your use of the Service in breach of these Terms, you will indemnify us against the resulting damages, costs, and reasonable legal fees. We will notify you of the claim promptly and let you lead its defense.
You may stop using the Service and close your account at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or if your use creates a security or legal risk, and we will give you reasonable notice where practicable. When your account is closed, Customer Content is deleted as described in our Privacy Policy. Sections that by their nature should survive termination (including ownership, limitation of liability, and governing law) survive.
We may update the Service and these Terms over time. If we make material changes to these Terms, we will give you reasonable advance notice (for example by email or in the product). Continuing to use the Service after a change takes effect means you accept the updated Terms.
These Terms are governed by French law, without prejudice to mandatory consumer-protection rules of your country of residence if you are a consumer in the European Union. For business customers, the courts of Paris, France have exclusive jurisdiction over disputes arising from these Terms, after a good-faith attempt to resolve the dispute amicably.
Questions about these Terms can be sent to support@heylemma.com.
These Terms are the entire agreement between you and Lemma about the Service, and they replace any earlier agreement on the same subject. If part of these Terms turns out to be unenforceable, the rest stays in effect (severability), and not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets. Neither of us is responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, internet or infrastructure outages, or acts of government.
